Organizer

The prize draw is organized by Wiener Tourismusverband, Invalidenstrasse 6, 1030 Vienna, Austria. The prize draw has no connection with Instagram or the parent company Meta, and is neither sponsored, supported nor organized by Instagram.

Participation

• Participation in the prize draw requires the participant to have an active account on the respective platform (Instagram). Only Instagram accounts held by a person with a real name are permitted. Participation using false identities or identities of third persons is not permitted.
• All natural persons aged 18 years and above are eligible to participate.
• By participating in the prize draw, the participant is not required to purchase any products, nor will he or she incur costs of any kind.
• By participating in this respective prize draw, the conditions of participation are deemed accepted.

Exclusion from the prize draw

• Employees of WTV and the participating businesses as well as relatives of the aforementioned employees and people living in the same household are excluded from participating in the prize draw.
• Should these conditions of participation be breached, WTV reserves the right to bar persons from participating in the prize draw.
• Also excluded are persons who make use of prohibited aids or gain other advantages through manipulation. If necessary, prizes can be revoked or recalled in such cases, even at a later date.

Holding and processing of the prize draw

• WTV is responsible for holding the prize draw and selecting the prizes.
• The winner will be drawn by WTV at random, unless stipulated otherwise in the text of the prize draw.
• The winner will be notified by private Direct Message (DM) on Instagram immediately after the prize draws closes. If the winner does not respond within one week of receiving notification that he or she has won, the claim to the prize shall lapse without substitution.
  In this case, a one-time replacement winner will be chosen. The replacement-winner will be notified by private Direct Message (DM) on Instagram immediately after the prize claim has lapsed for the first-picked winner. If the replacement-winner does not respond within one week of receiving notification that he or she has won, the claim to the prize shall lapse without substitution.  In this case, a second replacement winner will not be chosen. 
  There is no obligation to accept the prize.
• The participant is responsible for ensuring that the provided email address or postal address is correct.
• Only one prize per participant is possible.
• The prize cannot be redeemed in cash, exchanged, or transferred to other persons.
• WTV reserves the right to make changes and additions to the prize draw or to cancel the prize draw without prior notice. This applies in particular in the event of force majeure or if the prize draw cannot be held or continued for organizational, technical or legal reasons.

Data protection, data processing, and data transfer

• The data of the participants will not be stored or archived by WTV. After the end of the prize draw and the distribution of the prizes, all collected personal data will be erased. The participant is at liberty to withdraw his or her consent to the storage of his or her data at any time and in doing so to withdraw from participation in the prize draw.
• The data will not be transferred to third parties unless these are participating businesses for the prize draw or service providers / tour operators for WTV. 

Liability

• WTV is released from all obligations by handing out the prize. WTV is not liable for legal and/or material omissions.
• The winner is notified without warranty.
• WTV is not liable for any damage that could be caused by errors, delays or interruptions in transmission, for faults with the technical systems and the service, incorrect content, loss or erasure of data, viruses or in any other way during participation in the prize draw, unless such damage is caused by WTV (its bodies or employees) either intentionally or through gross negligence.

Final provisions

• Should the conditions of participation contain ineffective provisions, the effectiveness of the other provisions shall remain unaffected.
• Austrian law applies. Legal action for the purpose of verifying the draw is ruled out.
